By booking a course or event via this website, you agree to abide by these terms and conditions. Please note, all attendee(s) are required to sign a copy of these terms and conditions and a release & waiver form before participation.

BMW Motorrad Performance Academy and the Contract

All motorcycle training and courses are managed by Focused Events Ltd, trading as BMW Motorrad Performance Academy, ("BMW Motorrad Performance Academy" / "We"). The “Student(s)” / “Rider(s) / “You” is / are the person(s) confirmed on the course confirmation letter. "Force majeure" is any situation beyond the control of BMW Motorrad Performance Academy, which can be, but is not limited to, war, terrorist activity, natural disaster, civil strife, adverse weather or road conditions, fire, and bureaucratic obstacles.

BMW Motorrad Performance Academy reserves the right to decline any booking at their discretion. The student(s) are required to sign a copy of the terms and conditions and a release and waiver form. Variation of the terms of this contract is only valid if done so in writing and signed by both the student(s) and an authorised representative of BMW Motorrad Performance Academy.

Payment

We require full payment in advance on booking to secure your requested dates. Until payment is received your course dates, they will not be confirmed, and these dates will be made available to other student(s).

Payment can be made using our secure payment portal, via this website. Please contact us if you require further information regarding alternative payment options.

If you wish to cancel or to transfer a course

Please be aware you have 14 days from the date of booking, to make amendments to your booking free of charge. Changes or cancellations after this time may incur a fee, as detailed below.

Should you wish to cancel your course:

- If cancellation is made with more than 28 days’ notice before the commencement of the course, the amount paid will be returned to you, less an administration fee of 10%.

- If you cancel your course with less than 28 days’ notice, then we are unable to provide any refund, irrespective of personal circumstances.

Should you wish to postpone or transfer your course:

- If the request to postpone/transfer/name change is made with more than 28 days’ notice, we’ll be happy to assist with no administration fee. A credit note will be issued for postponements, valid for the duration of 1 year

- If the request is made with less than 28 but more than 15 days’ notice, a postponement/transfer or name change is permitted but subject to a 10% administration fee. A credit note will be issued for the value of your booking, less the agreed fee.

No changes are permitted with less than 15 days’ notice and no refund will be made, irrespective of personal circumstances. During your course, if you are unable to continue with your training, for whatever reason, then no refund of the course cost is given.

All requests for cancellation must be in writing, sent via post or email. World of BMW will acknowledge said request within 5 days. Changes are at the organiser’s [BMW Motorrad Performance Academy] discretion and while every effort will be made to accommodate them, we cannot guarantee the requested changes.

Customers are responsible for any increases in course cost, as well as rebooking using the credit note(s) provided. All credit notes issued are valid for a duration of 1 year and are non-refundable and non-transferrable. Courses are extremely popular and are often booked up in advance; World of BMW and BMW Motorrad Performance Academy cannot be held responsible for the availability of courses should customers wish to transfer dates.

If we cancel or transfer a course

BMW Motorrad Performance Academy are not responsible for any adverse weather conditions that may affect circuit availability. However, if an event is cancelled due to extreme weather conditions and no circuit activity has taken place, then we will transfer your booking to another date or issue you with a full booking value credit note. Please note, we cannot be responsible for third party costs incurred due to any cancellation.

Requirements for Participation

Rider requirements

- You must bring the photocard element of your full, current, unrestricted (not 33bhp or 47bhp restricted), valid UK driving licence as issued by DVLA and present it at registration. If using an ACU licence you must be 18 years of age or older and if using a Scottish ACU licence you MUST bring your passport to confirm your age.

Equipment requirements

All Riders must wear the following, at all times whilst on the circuit:

  • A one- or two-piece leather suit that MUST zip together fully i.e., around the hips to protect the whole body.
  • A helmet that meets BSI 6658 type A, with the ACU gold stamp
  • Leather motorcycle boots
  • Leather motorcycle gloves, ideally with a cuff strap
  • A back protector

Please note: Titanium sliders and boot edges are prohibited, and Two-piece suits that connect via a short zip in the rear are unsuitable.

Your Safety and Responsibilities

Motorsport is a dangerous activity and by its very nature, involves a high degree of risk that can lead to personal injury or death. Despite BMW Motorrad Performance Academy taking all reasonable precautions, accidents can happen. By booking a course or event via this website, you acknowledge this and confirm that you are aware of the nature of the activity and attend at the venue at your own risk.

Your responsibilities are as follows;

- You are responsible for always acting in accordance with the directions and advice given to you by your instructor during your training sessions.

- You are also responsible for making sure that you are adequately dressed and protected for motorcycle riding.

- You are obliged to inform us of any physical or medical condition or otherwise that could adversely affect safety or training.

- You must bring your UK driving licence with you for all your training. It is your responsibility to ensure that your UK driving licence is valid and in your possession for training. Should your licence not be valid, or you do not bring it to the course, then you will not be able to take the course and you are not entitled to a refund.

For courses with a range of 'Level' options available

BMW Motorrad Performance Academy recommends all students attend the Level One course, in order to be assessed for safety, however all students must attend a minimum of Level Two before proceeding to Level Three or M Experience courses. The organisers [BMW Motorrad Performance Academy] reserve the right to cancel any booking for Level Three and/or M Experience events, where prior Level Two attendance cannot be substantiated. No refund will be made, however a credit note will be issued for rebooking a more suitable course, valid for the duration of 1 year.

BMW Motorrad Performance Academy reserves the right to alter your group or Level as booked, unless we are completely satisfied that your motorcycle handling and riding ability meets the required grade necessary for the course chosen. If for whatever reason, your instructor assesses that you are unable to meet the required grade, you will be moved to a lower Level / alternate training group more appropriate for your ability grade. No refund will be made as a result of this change.

For courses with a range of motorcycle models used

BMW Motorrad Performance Academy will not upgrade you to a larger bike unless we are completely satisfied that you are able to handle the machine safely. If for whatever reason, you do not handle a larger machine safely, then we reserve the right to restrict you to a smaller machine.

BMW Performance Academy reserves the right to cancel any tuition should there be a suspicion that the student is under the influence of drink/drugs or if the student is not legal to ride (e.g., you fail an eye test). We also reserve the right to stop tuition at any time when the student is not safe on the circuit and acting against the interests of safety, and/or those whose behaviour is likely to cause damage, nuisance, or injury. No refund of fees will be made in such a situation.

Liability

Although every effort is made to ensure your safety during your course, you must realistically accept that there is a possibility that an accident may occur that causes loss, damage, expense, personal injury, or death to you. BMW Motorrad Performance Academy are not responsible for any loss, damage, or injury to persons or property caused or sustained by you as result of attendance at any training course or motorcycling event, save for liability for death or personal injury arising from BMW Motorrad Performance Academy negligence or for fraudulent misrepresentation.

Complaints

If the student(s) have a complaint about the training course, in the first instance the student(s) must inform the Chief Instructor as soon as is practical, so that remedial action can be taken if possible.

Thereafter, the student(s) must make the complaint in writing within the first 30 days of the training course or event finish date, sending it via email to BMW@WorldofBMW.com or by post to World of BMW, BMW Motorrad, Summit ONE, Summit Avenue, Farnborough, Hampshire GU14 0FB
